1. Agreement to Terms

By accessing or using the services provided by BinoMatrix ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. Our services include SaaS & MVP Development, AI-Powered Web Applications, Mobile App Development, and UI/UX Design.

2. Services and Scope of Work

BinoMatrix provides custom software development and design services. The specific scope of work, deliverables, and timelines will be outlined in a separate agreement or proposal provided to you before the commencement of any project. We reserve the right to modify or discontinue services at our discretion.

3. Payment Processing and LemonSqueezy

All payments for our services—including monthly subscriptions, quarterly subscriptions, and one-time project fees—are processed securely through our authorized merchant of record, LemonSqueezy.

By purchasing a service, you also agree to LemonSqueezy's Buyer Terms of Service. LemonSqueezy handles all payment data, invoicing, and tax compliance. BinoMatrix does not directly store or process your credit card information.

4. Refund Policy

Due to the high-quality, custom nature of our software development and design services, we typically do not offer full refunds once substantial work has begun.

However, we want you to be completely satisfied. If you decide to cancel during the initial planning phase within the first few days of your billing cycle or project kick-off, we will work with you to make it right or issue a prorated refund for any unallocated hours.

5. Intellectual Property

Upon full and final payment for the services rendered, you will own the full source code and intellectual property rights to the final deliverables, unless otherwise specified in your specific project agreement. BinoMatrix retains the right to use underlying open-source libraries, general frameworks, and non-proprietary code snippets across other projects.

6. Client Responsibilities

You agree to provide timely feedback, necessary assets, and clear communication to ensure project timelines are met. Delays on the client's end may result in adjustments to the delivery schedule.

7. Limitation of Liability

BinoMatrix shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services or any software we develop for you. Our maximum liability shall not exceed the amount you paid us for the specific services in question.
